Abstract: In this study we analyze the effect of the so-called “pro actione” principle has in the work process, as a hermeneutic criterion made by the jurisprudence of the Constitutional Court and it imposes to the national courts, even those of social order, to interpret the procedural rules and their formal requirements, in the most favorable sense for the effectiveness of the right to effective legal protection, so that those requirements do not become mere obstacles which mean an unjustified impediment for the access to justice.
