Abstract: In this paper, we propose a reflection about the current model of Smart Cities, the concept
of Societies 5.0 and how the human and fundamental rights can fit into this model. In fact, the expression
Smart city became popular in the last years and the main reason for the emergence of this concept was the
need to create spaces with social equality, quality of life, safety and sustainability, through a highly efficient
use of the technological tools. It is known that Smart Cities can also relate to important topics, concerning
humanitarian matters. Therefore, addressing this subject also implies in arguing about the creation of a
society where its dynamics is thought to promote fundamental rights, i.e., where the human being and its
intrinsic dignity can still be placed at the center of legal and social arenas. In the current model of society,
a lot of social injustices or segregations still occur in the urban space and because of this, the Internet of
Things (IoT), the Artificial intelligence (Ai), and Big Data can be part of a new society proposal, a new
level, the super-smart cities, but also intending to correct some of the biggest urban social problems. This
model is only possible thanks to the advanced technologies that are already used in industry 4.0 nowadays,
leading us to a 5.0 model, with the development of new and better technological tools. Thus, we aim to
address these topics, linking one to another.
