Abstract: For some time now, the reparatory tutelage of the infringement of fundamental rights in the work contract, is getting a special impetus by some regulatory reforms (LOIMH, RD Legislative 1/2013 –previously LIONDAU–). After the entry into force of the LJS, this reinforcement increases –from the procedural dimension– and, besides, the legal tenor lets us raise if that compensation does not show different profiles to the mere damage compensation. We now look into the essence of the compensation by damage caused by the infringement of the fundamental rights and the possibilities open by the latest reforms on it. We start from an initial reflection on the object and the function of the damage compensation and its realization in cases of infringement of the non specific fundamental rights and it confirms the need for a work reframing of the legal liability in this area or, at least, to add some own criteria. In the context of the current debate of the civil doctrine around the functions of the civil responsibility, we deal with and eventual translations to the Spanish Law of the damage of the punitive damages of the Common Law and the problems it raises.
