Labour law in time of crisis

Abstract: Labour law has always been developed around the economic crisis, adapting to it. This fact causes its structural ambiguity. However, it is clear that a crucial point in its shaping is given by the constitutionalization of labor in the post-war world period in the main European countries. The current situation makes us call this political commitment into question through the verification of the uncontrolled violence of the economic crisis and its impact on labor rights. The exceptional situation posed by the crisis affects not only the economy, but it directly involves an erosion of the democratic safeguards. In view of this, it is possible to give a political and trade union response, but the contribution of the labour lawyers to the exit from the crisis may also be crucial for the theoretical reconstruction of equality areas and dignity at work.

The role of the social interlocutors in view of the reform of the collective bargaining: challenges and options

Abstract: This article shows a critical view on the reform of 2011 of the system of collective bargaining, so, it is made some time before the reform of 2012. Far from succumbing to the temptation to "touch up" in the light of the recent regulations changes, the analysis of the previous legal precedent has the implication to show the contrast between both reforms, specially related to the role of the social agents. The RDL 3/2012 has dealt with the deepest reform of the legal frame of the collective bargaining since its adoption in 1980, affecting completely the whole Title III of the ET. The RDL 7/2011, from 10th June, made big and deep changes in this legal text, however, and although some people want to remark that the reform of 2012 is only another "clamp down" with regard to the previous reform, it is really now...
