WORKING TIME AND FLEXIBILITY IN LUXEMBOURG

Introduction
As stated in a report of the Luxembourg Chamber of employees regarding the quality of
work in Luxembourg
9, the Luxembourg labour market is dominated by the service and
public sectors. Most of the employees are working for small and medium companies
and 1/3 of them are working for companies having more than 250 employees. 97,5% of
the employees have a single labor contract, and only 2,5% have several contracts. Most
of the contracts in Luxembourg are long-term contracts, and only 4% have a short-term
contract, and 2% of the employees are working under an interim agreement. 81% of the
employees are working full-time.
As what regards more specifically the working time, in a survey10 conducted by the
Luxembourg national statistics institute during the last 4-years period (2008-2012),
published in November 2014, the institute concludes that the average annual working
time in Luxembourg (2012) is 1773 hours, which reflects a slight decline, following the
sharp rise which was observed during the previous period (Please, refer to the graphic 1
at the end of this paper). Overtime is declining as well and absenteeism is stable. This
average number of working hours, however, remains higher than the one of the
European Union, and that of the neighboring countries or areas (Please, refer to the
graphic 2 a t the end of this paper). 17,5% of the Luxembourg workers work part-time,
less that the European Union average of 25,3%.
1. Does the regulation on working time establishes a daily, weekly and/or annual
limit of working hours? If so, what is the maximum working hours?
The general principle (hereafter, the General Regime) lays in article L.211-5 (book 2,
Title I, Chap. 1, Section 3) of the Luxembourg Labour Code, which states that the limit
of working hours11 of the employees in Luxembourg is fixed at 8 hours a day and 40
hours a week.
