Abstract: This text, made by a group of scholars, plans the interpretative problems created by the weak legislative technique of the Law 3 /2012 on the temporary duration of the collective agreements, which breaks the classical tendency lines of the collective agreement in Spain. It is preserved that the ultra-activity terms agreed in the collective agreement must be respected and they establish exceptions to the legal formula of the ultra-activity period. On the other hand, when the collective agreement has not predicted them and it loses its validity by the cause of the legal term, however the duty to negotiate is maintained according to the good faith in a new collective agreement, this duty must be protected in the judicial process by procedural channel of guardianship of the trade union freedom. The end of the ultra-activity in the legal formula implies the application of the superior scope agreement if this exists, requiring the act of application a voluntary mediation of the employer and the information to their union or trade union representatives, which can be replied...
