El secreto estadístico y el padrón municipal de habitantes

RESUMEN
El Padrón Municipal de Habitantes es un documento cuya titularidad corresponde al respectivo Ayuntamiento,
fundamental para la gestión de la población municipal por las importantes consecuencias que se derivan de
la inclusión en el mismo, y junto con ello, por la gran cantidad de información que en él se recoge con carácter
obligatorio. Esas características hacen que se convierta en una fuente de información muy reclamada por
diversos agentes, entre los que destacan muy especialmente el resto de Administraciones Públicas. El
Tribunal Supremo ha rechazado rotundamente que los Ayuntamientos puedan negarse a ceder los datos
incorporados al Padrón municipal a otras Administraciones que los reclamen en el legítimo ejercicio de sus
propias competencias amparándose en la institución del secreto estadístico. En este artículo trataremos de
analizar si, efectivamente, el secreto estadístico resulta absolutamente inaplicable a la información padronal.

ABSTRACT
The municipal register of inhabitants is a document which belongs to the respective City Council, fundamental
to the management of the municipal population for the important consequences of the inclusion in it and
by the large amount of information that it compulsorily collects. These characteristics make it become a
source of information very requested by different agents, among them must be especially noted the rest
of Public Administrations. The Supreme Court has flatly rejected that City Councils may refuse to give
data included in the municipal population register to other Administrations that claim them in a legitimate
exercise of its own powers, by application of the institution of statistical confidentiality. This article will
attempt to analyze whether, indeed, the statistical confidentiality is absolutely irrelevant to the information
included in municipal registers of inhabitants.
