PRESENTACIÓN AL Nº 18 DE “HISTORIA
CONSTITUCIONAL”
Entre los once Estudios que se
incluyen en esta décimo octava entrega de
“Historia Constitucional”, los cinco primeros
se dedican a España, desde la segunda mitad
del siglo XVIII hasta finales del siglo XX,y en
ellos se abordan el problema de la desigualdad
y sus relaciones con la Economía política y el
liberalismo, la privatización del patrimonio
nacional, la organización territorial, la libertad
de cultos y la libertad de enseñanza. Los tres
Estudios siguientes se ocupan del
“constitucionalismo otorgado” en Brasil y
Portugal, así como del derecho de resistencia
en este último país, sobre el que se reflexiona
también al hilo de algunos proyectos
constitucionales. A continuación, dos Estudios
se centran en los primeros años de los Estados
Unidos de América, con el examen de la
interpretación constitucional de los “Padres
Fundadores” y con una semblanza biográfica
de John Jay. El último Estudio se ocupa de lo
que puede calificarse de Teoría de la Historia
Constitucional. A esos once Estudios se
añaden seis recensiones sobre obras muy
variadas de notable interés para la historia
constitucional europea (española, francesa,
italiana, suiza y belga) y mexicana.
Con el presente número me despido
como director de “Historia Constitucional”. A
partir del número siguiente me sustituirá
Ignacio Fernández Sarasola, secretario de la
Revista desde su fundación en el año 2000, a
quien doy las gracias por su generosa
dedicación a ella y a quien deseo mucho éxito
en su nueva tarea. Este agradecimiento lo
extiendo al Consejo de Redacción y al Consejo
Científico Asesor de “Historia Constitucional”,
así como a las instituciones española que han
hecho posible su continuidad: el Seminario de
Historia Constitucional “Martínez Marina”, de
la Universidad de Oviedo, el Centro de
Estudios Políticos y Constitucionales, así como
el Consejo Superior de Investigaciones
Científicas. Estoy seguro de que este respaldo
institucional lo mantendrá Ignacio Fernández
Sarasola, al igual que la confianza de sus cada
vez más numerosos colaboradores y lectores,
sin la cual “Historia Constitucional” no sería
posible.

PRESENTATION OF THE 18TH ISSUE OF
“HISTORIA CONSTITUCIONAL”
Of the eleven studies included in this
eighteenth edition of “Historia Constitucional”,
the first five are focused on Spain from the
second half of the eighteenth century until the
end of the twentieth century. These studies
address the problem of inequality and how it
was related to political economy and
liberalism, the privatisation of state assets,
territorial organisation, religious freedom and
academic freedom. The following three studies
examine the “imposed constitutionalism” in
Brazil and Portugal and the right to resist in the
latter country. Some Portuguese constitutional
projects are also studied. The next two studies
focus on the early years of the United States of
America, with an analysis of the constitutional
interpretation of the “Founding Fathers” and a
biographical sketch of John Jay. The final
study is concerned with what could be classed
as the Theory of Constitutional History. In
addition to these eleven studies there are six
reviews of widely differing works which are
highly interesting from the point of view of
European (Spanish, French, Italian, Swiss and
Belgian) and Mexican constitutional history.
With this eighteenth issue I step down
as the director of “Historia Constitucional”.
From the next edition I will be replaced by
Ignacio Fernández Sarasola who has been the
secretary of the journal since its foundation in
2000 and to whom I express my thanks for his
generous dedication and to whom I wish every
success in his new role. I also wish to extend
my gratitude to the Editing Board and the
Scientific Advisory Council of “Historia
Constitucional” together with the Spanish
institutions that have made its continuity
possible: “Martínez Marina” Seminar of
Constitutional History of the University of
Oviedo, the Centre for Political and
Constitutional Studies and the Higher Council
for Scientific Research. I am sure that this
institutional support will continue with Ignacio
Fernández Sarasola as director, as will the
endorsement by the journal’s many
collaborators and readers without which
“Historia Constitucional” would not be
possible.
