PRESENTACIÓN
Esta nueva entrega de Historia
Constitucional se abre con un estudio de
Maurizio Fiorvanti sobre La Costituzione
democratica del novecento: genesi e prospettive.
Le siguen once estudios más, agrupados según
criterio exclusivamente cronológico. Así, en una
primera sección, dedicada a los siglos XVII y
XVIII, se incluye un estudio sobre el siempre
sugerente pensamiento de Spinoza y otro sobre
la primera ley electoral en los Estados Unidos de
América. Una segunda sección, centrada en el
siglo XIX, particularmente en su primer tercio,
contiene un estudio sobre el reglamento
parlamentario en los orígenes del
constitucionalismo europeo, también el español,
y otros tres que, de un modo u otro, están
relacionados con la Constitución de Cádiz. En
ellos se aborda la libertad religiosa en esa
Constitución y en la de 1837, la circulación y
difusión de las ideas “fraternales y cosmopolitas”
durante el Trienio Liberal (1820-1823), y un
estudio sobre el análisis de Karl-Ludwig Von
Haller acerca de la Constitución doceañista en
1823. La tercera sección, centrada en el último
tercio del siglo XIX y primeras décadas del XX, se
compone de dos estudios. El primero de ellos
analiza los estereotipos de género y matrimonio
regio como estrategia de legitimación en la
monarquía española contemporánea, mientras el
segundo escudriña la forma en que se pe rcibió la
justicia en España a comienzos del siglo XX. De
este siglo se ocupan los tres estudios siguientes,
que conforman la cuarta y última sección, en las
que se contemplan, respectivamente, la
naturaleza jurídica de la llamada “República
Social Italiana”, la justicia constitucional
vertebrada en Colombia por el general Gustavo
Rojas Pinilla, y, en fin, el programa del
Movimiento de las Fuerzas Armadas Portuguesas
tras el 25 de abril de 1974. Cuatro recensiones
sobre obras muy diversas y una noticia sobre un
Coloquio acerca de la influyente Constitución
mexicana de 1917- justo cuando estamos en
vísperas de conmemorar su bicentenario- en el
marco de la tradición constitucional de ese país,
cierran esta entrega, la decimoséptima, de
“Historia Constitucional”.
En otro orden de cosas, me complace
señalar que la FECYT –el organismo oficial que
evalúa la calidad de las publicaciones científicas
españolas– ha renovado el sello de calidad de
nuestra Revista para el trienio 2016-2018. Una
grata noticia, ya que, además, “Historia
Constitucional” ha recibido esta certificación de
forma continuada en las últimas cuatro
convocatorias de evaluación.

PRESENTATION
This new issue of Historia Constitucional
opens with a study by Maurizio Fiorvanti on La
Costituzione democratica del novecento: genesi e
prospettive. It is followed by a further eleven
studies, strictly grouped according to
chronological criteria. The first section, dedicated
to the seventeenth and eighteenth centuries,
includes a study on the always suggestive
thought of Spinoza and another on the first
electoral law in the United States. The second
section, focused on the nineteenth century,
particularly on the first thirty years, contains a
study on parliamentary rules in the beginnings of
constitutionalism in Europe and Spain and
another three studies which, in one way or
another are related to the Constitution of Cadiz.
The first of these three articles addresses the
religious freedom in this Constitution and in that
of 1837, the second examines the circulation and
diffusion of “fraternal and cosmopolitan” ideas
during the Liberal Triennium (1820-1823), and
the third constitutes an analysis of Karl-Ludwig
Von Haller on the twelve-year constitution of
1823. The third section, focused on the last third
of the nineteenth century and early decades of
the twentieth century comprise two studies. The
first analyses gender stereotypes and royal
marriages as a legitimation strategy in the
contemporary Spanish monarchy, while the
second examines the way in which the Spanish
justice system was perceived at the beginning of
the twentieth century. The fourth and final
section contains three studies dedicated to the
twentieth century which contemplate the legal
nature of the so-called “Italian Social Republic”,
the constitutional justice created in Columbia by
Gustavo Rojas Pinilla, and the programme of the
Portuguese Armed Forces movement after the
25th April 1974 respectively. This seventeenth
edition of “Historia Constitucional” is closed with
four reviews of highly diverse works and an
announcement about a talk on the influential
Mexican Constitution of 1917, in the build up to
its bicentenary, within the framework of Mexico’s
constitutional tradition of this country,.
On another note, I am pleased to inform
you that the FECYT – the official body that
assesses the quality of Spanish scientific
publications – has renewed the quality seal of our
Journal for the three-year period 2016-2018.
This is good news, as “Historia Constitucional”
has received this certification in the last four
assessment processes.
