LA ORDENACIÓN JU RÍDIC A DE LA PARTICIPACIÓN JU VE NIL

Resumen
Este trabajo pretende, en el actual contexto de inmenso desapego de la sociedad
civil por la cos a pública, exami nar las bas es jurídicas existentes tanto a nivel nacional
como en la esfera internaciona l para gar antizar la participación de un colectivo social
tan import ante como el juvenil en el desarrol lo político, social, económico y cu ltural.
Se analiz a, en concreto, el anclaje constitucional de esta cuestión en España a través
del art. 48 C .E., así como el desar rollo histórico de este precepto con la creación del
Consejo de la Juventud de España en 1983, cuya naturaleza jurídica h a pasado de ser
pública para tr ansformar se en una verdadera a sociación sector ial de base privada. Se
estudian, asimismo, l as principales organ izaciones internacionales gubernamentales (en
particul ar, la Unión Europea y el Consejo de Europa) y no gubernamentales (sobre
todo, el Consejo Europeo de la Juventud), que constituyen oblig ado referente para la
ordenación de los cauces juríd icos de la participación juvenil en nuestro país .
Abstract
In the current context w ith complete disregard for the public issue by the ci vil society,
this paper ana lyses the nat ional and internat ional legal ba sis in order to gua rantee the
youthful participation in t he political, soc ial, economical and cultural development. In
particul ar, we focus on the Spanish que stion through the examination of article 48 of
Spanish Const itution. On this article the Spanish Youth Council w as created in 1983 as
a public institution, a lthough his legal nat ure has become private association this yea r.
Additionally, we exam ine the main governmental organi zations (that is, European Union
and Council of Europe) and non-governmental orga nizations (especia lly, the European
Youth Forum) in the meaning that t hey are a compulsor y reference to understand the
legal course about youth participation in our country.
