Abstract: This article introduces a critical analysis of the main problems the temporary contract faces in the Public Administration. It starts with a reflection about the effect the selective abstentionism of the law-maker has had on the huge precariousness of the public work. Then we analyze, related to the job boards, the competence attribution to the social jurisdiction made by the present social regulatory law of the social jurisdiction. We also present the problems created by the figure of temporary civil servant and we analyze other ways of precariousness in the Administration, like the outsourcing (by means of contracting company or TTEs) or by false self-employed people. We pay special attention to the late jurisprudential doctrine which reinforces the causality of the work contract in the Administration. The article ends with the analysis of the figure of non-regular permanent worker, especially related to its contract expiration.

INEQUALITY, INSECURITY AND UNCERTAINTY IN THE LEGAL ANALYSIS OF GENDER

Abstract: The article analyzes the use of some concepts in its application to gender and labor legal studies and content that corresponds to them. While talking about inequality leads to discriminatory treatment and therefore viewed from the principle of non-discrimination, vulnerability is a category that situates the analysis in the most limited of poverty and social exclusion space, associating the concept of victim. By contrast, the term precariousness is a way of productive analysis in terms of criticism of the regulation of work and the currently existing social protection, which is implicit in labor law specialists studies undertaken this theoretical approach a form of denunciation fundamentally unequal employment, but also indirectly refers to the imposition of a low-skilled work as employment priority.
