The possibility to enforce the debtor’s assets in order to satisfy the creditor’s
credit constitutes the culmination of the right to the effective judicial protec-
tion included in article 24 of the spanish Constitution. Notwithstanding, at
times the culmination is not possible as not sufficient goods are found for
the purposes of the enforcement. Therefore, the location of the debtor’s as-
sets is a particularly important matter of evident public interest. Even though
a strong patrimonial investigation did not mean a definite solution for the
insolvencies, it would increase the success of the enforcement regarding sol-
vent debtors who hide its assets to the detriment of their creditors. In addi-
tion, it would improve substantially the citizens’ trust in the administration
of justice in Spain.
This work evaluates the current regulations of the Spanish legal system, an-
alysing the means and investigation liabilities of all the parties involved, that
is, the creditor, the debtor, the investigation made by the court, and, finally
the third party duties of cooperation, taking into account in each moment the
respect to the constitutional and legal rights. Furthermore, the work anal-
yses the options of comparative law which could be useful as a reference.
All of that, with the aim to conclude a set of measures of practical imple-
mentation and of lege ferenda to improve the effectiveness of the system.
