The fi rst democratic, free and fair elections (and its processes) are
commonly addressed in the literature as the most important stage in any
transition to democracy. Although this idea is relatively consensual and
founding elections have been broadly studied, there is a lot to explore
about the factors that, in the context of such elections, may have a
significative impact on the newly established democracies. One of
these factors is related with the individuals excluded from this process
as a result of their role in the former regime – those withdrawn of their
political rights as a result of a lustration process.
Lustration is a type of transitional justice mechanism commonly
adopted in the context of transitions by rupture or collapse to remove
individuals associated with the former regime from governments or the
military or to prevent them from regaining access to these positions.
The literature on this mechanism is abundant, but it rarely looks at one
of its many formsŚ the limitation of political rights. The removal of the
former elite from positions of public infl uence is the most commonly
studied phenomena (David, 2017ś Horne, 2009ś Olsen et al., 2010),
which explains the fact that there are few known cases were the limitation
of political rights was implemented. This chapter aims to contribute to
the broader debate about the impact of these measures on democratic
consolidation, with a brief presentation of the case of Portugal. The
Portuguese democratization stands out due to its peculiarities, one of
them being the means of dealing with the past, since the country faced
an extremely punitive process that encompassed all types of transitional
justice mechanisms. But one question remains unansweredŚ what was the
