RESUMEN
Para entender qué es la Justicia Restaurativa resulta conveniente, como se
verá en este artículo, analizar cuáles son los factores determinantes de su
surgimiento, además de su origen tanto cercano como más remoto. Una vez
sentadas estas bases, de la necesidad y las bondades de esta Justicia, se
intentará su conceptualización de forma amplia, teniendo en cuenta que Jus-
ticia Restaurativa es mucho más que mediación penal. Así, entendiendo Jus-
ticia Restaurativa como un paradigma jurídico-filosófico o incluso como
una ciencia penal, podemos valorar que existen muchas herramientas para
aplicarla en la práctica, y que la mediación penal es solo una metodología
más, y ni siquiera la más restaurativa. El Estatuto de la víctima recoge esta
visión amplia de la Justicia Restaurativa, al hablar de los Servicios de Jus-
ticia Restaurativa. Se verá además cómo esta norma tiene un claro enfoque
restaurativo. El reto subsiguiente, siguiendo este Estatuto de la víctima, será
la inclusión dentro de las Oficinas de Asistencia a la Víctima de los Servicios
de Justicia Restaurativa; de esta forma, no es descabellado pensar en esta
justicia como un derecho más de las víctimas, con independencia del delito
sufrido.

ABSTRACT
To understand what Restorative Justice is, it is convenient, as it will be dis-
cussed in this article, to analyze what elements are related with its origins
both near and more remote. Once these basics of the need and the benefits
of this Justice are establish, I will try to reach a good and a wide concept,
considering that Restorative Justice is much more than criminal mediation.
So, understanding Restorative Justice as a legal-philosophical paradigm or
even as a criminal science, we can appreciate that there are many tools to
put in practice, and that this criminal mediation is only a methodology and
even not the most restorative. The Statute of the Victim reflects this broad
view of Restorative Justice when it speaks about Restorative Justice Ser-
vices. We will also see how this law has a clear restorative approach. The
subsequent challenge, following this Statute of the victim, will be the inclu-
sion within the Victims’ Assistance Office, the Restorative Justice Services,
thus it is not unreasonable to think of this justice as a right of the victims
regardless of the offense suffered.
