Abstract: we analyze the possibilities of judicial intervention to control the legal correction of some business decisions related to the work flexibility. This analysis is made under the changes brought in by the Law 3 / 2012 and we fundamentally analyze the judicial control of the decisions with regard to functional and geographic mobility and change of working conditions, including the assumptions of no application of collective agreement of general efficacy.

In this sense we analyze the demands which persist in the substantive code as limits to the unilateral proceeding of the employer, specially related to the causality demands, the procedural rules and the solution of the possible disagreements between the parties. Established them, we study the possibility that the social jurisdictional organs act in connection with each aspect, pointing out the intervention proceedings and the real possibility to control the business decisions, emphasizing the importance of the real control which demands the respect to the procedural steps and it can assess adequately...
