This work analyzes the situations that can give rise to the inadm issibility of
the pre-judicial questions of an interpretative nature; currently regulated, to-
gether with validity, in article 267 of the Treaty on the Functioning of the Eu-
ropean Union (TFEU). There exists no clear, precise description of the different
causes that can give rise to the inadmissibility of the remittance by the Court
of Justice in the procedural regulations of the European Union. It has been the
Court of Justice itself, interpreting the said regulations, which has established
such causes. None of such causes refers to the parts in the lawsuit before the
national Judge, so it is not the national Judge’s defective proceedings, or the
circumstances pertaining to them, that can lead to the inadmissibility of the
remittance. It is, however, the internal Judge’s irregular proceedings on con-
sidering the question that can, on the basis of jurisprudence, enumerate the
various reasons for the inadmissibility. The paper analyzes these reasons in
view of the opinion concerning the doctrine and, in particular, the jurispru-
dence of the Court of Justice.
