RESUMEN: La recién aprobada Constitución cubana consagra a la tutela judicial efectiva
como principal garantía de los derechos refrendados en dicho texto. Se trata de una ins-
titución compleja que, en no pocas ocasiones, se confunde con el acceso a la justicia o el
debido proceso; sin embargo, son dos de los elementos claves que, junto a la obtención
de una sentencia motivada y razonable, su ejecución y la prohibición de indefensión,
conforman un macroconcepto que indica cabal cumplimiento de la función estatal de
impartir justicia y que resulta de aplicación a cualquier materia.

ABSTRACT: The recently approved Cuban Constitution enshrines effective judicial pro-
tection as the main guarantee of the rights it endorses. Due to its meaning complexity,
effective judicial protection is frequently confused with access to justice or the due
process of law; however, they are two of the key elements that shape a macro concept

which applies to all procedural types and that indicates the accomplishment of the
state function of justice administration, along with obtaining a reasoned and reasonable
judgment, its enforcement and the defenselessness prohibition.
