FIXED-TERM CONTRACTS AND PRINCIPLE OF EQUAL TREATMENT IN
GERMANY

Introduction
Fixed-term contracts are widespread in Germany. The concrete figures differ, depending
on the respective source. According to a study conducted by the Federal Statistical Office,
in 2015, eight percent of the employees worked in jobs with fixed-term contracts.42 This
applies to men (eight percent) and women (nine percent) alike. The number of fixed-term
contracts particularly increased after the controversial labor market reform “Agenda
2010” in 2004. Young people are more often in fixed-term employment. The “official”
data published by the Federal Statistics Office are as follows:

This fixed-term employment share would be lower than the European Union average
(11,3 percent).43 Others sources suggest a higher fixed-term employment share.
According to a survey carried out by the OECD, 14,4 percent of the German employees
work in jobs with fixed-term contracts.44 A request from the Federal Employment
Ministry has shown that 42 percent of new contracts of employment are fixed-term
contracts.45
