La razón del nacimiento de este movimiento jurídico está en la falta de la enseñanza de
este Derecho Real, Patrio o Nacional en las Universidades del Reino a los futuros licencia-
dos, sin perjuicio de que el profesorado de estas lo conociera en mayor o menor amplitud
y escribiera las prácticas forenses para ellos, o libros jurídicos de mayor calidad.

ABSTRACT: This work approaches the ﬁrst legal procedural movement, appeared in the
time, named Forensic Practice. That is to say, to the practical ones of the forum, the prac-
tice effected in this one and the formal source that gathers the above mentioned forensic
practices (written by them, narrating that practice) that are its legal texts like a simply
manual, ﬁrst manuscript and then printed where they explain the various formalities of
how there was applied the formal and material law to the concrete case.
It is necessary to analyze the origin of this movement, initiated in Italy, wherefrom it arrives
to Spain and Portugal and that coincides with a new political and economic situation that
he supposes the step from the High Middle Ages to the Late Middle Ages (13th century).
In the juridical plane, it coincides with the reception of the common Law existing in
Italy, Law, which is incorporated to our legal texts and thus becomes a new, national Law,
of foreign origin (Italian Common Law, Justinian Roman Law and Canon Law) that is
named Right in Rem or Native and as such Right has to be applied by the judges to the

The reason for the birth of this juridical movement is in the lack of teaching of this Right
In Rem or Native or National in the Universities of the Kingdom to the future graduates,
without prejudice that the university teaching of these knew it in more or less extent and
they were writing the forensic practices for them, or juridical books of higher quality.
