RESUMEN: El uso o destino de un piso en un edificio sobre el que se ha
establecido un régimen de propiedad horizontal se determina a distintos nive-
les y con distinto alcance: desde el título constitutivo de propiedad horizontal
donde se establece el destino que se le otorga en el plan urbanístico, hasta
el destino específico o concreto que puede darse a un determinado elemento
privativo en los estatutos. Ese uso previamente establecido es al que debe
destinarse el piso o local, pero puede cambiarse o alterarse. ¿Puede hacerlo
unilateralmente el propietario o será necesario el acuerdo con el resto de
los copropietarios en Junta? Analizamos las posibilidades de ese cambio de
uso, con especial referencia al cambio de destino de vivienda a turístico, en
los casos en los que un piso residencial se destina a alojamiento turístico o
alquiler vacacional.
ABSTRACT: The use or destination of a flat in a building on which there has
been established a regime of horizontal property decides to different levels and with
different scope: from the constitutive title of horizontal property where there is es-
tablished the destination that grants him in the urban development plan, up to the
specific or concrete destination that can be given to a certain exclusive element in
the bylaws. This first established use can be changed, but how can we do that? Can
the owner change it or it is necessary the agreement with the rest of co-owners?
We analyze the possibilities of this change of use, with special reference at the rate
of housing to tourist destination, in the cases in which a residential property is
destined to tourist or sharing housing.
