RESUMEN
Las directivas comunitarias son una de las fuentes de derecho derivado de
mayor importancia, por ello el reconocimiento de su eficacia directa en toda
su extensión, a nivel vertical y o horizontal, va a resultar clave a la hora de
impregnar criterios de seguridad, uniformidad y celeridad en su aplicación
por parte tanto de los jueces nacionales como de los jueces comunitarios.
Analizaremos los últimos dictados del TJUE favorables a tal admisión, en
la aplicación de la Directiva 2000/78 en materia de no discriminación en el
trabajo, así como la incidencia que la aplicación directa de las directivas
comunitarias está teniendo en el orden laboral y muy especialmente en el
ámbito de la contratación temporal. Decantarse por la aplicabilidad directa
en toda su extensión de las directivas comunitarias, tanto a nivel vertical
como horizontal, a nuestro modo de ver supondría dotar de una mayor uni-
formidad, seguridad y homogeneidad en el ámbito de las relaciones jurídi-
cas entre particulares en relación con la norma comunitaria.

ABSTRACT
Community directives are one of the most important sources of derivative
law, for this reason the recognition of its direct efficacy in all its extension,
at a vertical and/or horizontal level, will be key when impregnating security
criteria uniformity and speed in the application of them by national judges
as community judges. We will analyze the latest dictates of the CJEU in favor
of such admission, in the application of the 2000/78 directive on non-dis-
crimination in the workplace, as well as the incidence that the direct appli-
cation of the EU directives is having on the labor order and especially in the
field of temporary hiring. Opting for the direct applicability in all its exten-
sion of the communitarian directives, so much to vertical or horizontal level
to our way of seeing would suppose to endow of a greater uniformity, hy-
giene and homogeneity in the scope of the juridical relations between indi-
viduals in relation with the community norm.
