DE UN GOBIERNO EN FUNCIONES

RESUMEN
La realidad de una España con un Gobierno en funciones durante 315 días
ha derivado en la necesidad de reflexionar sobre el fundamento y las carac-
terísticas de un fenómeno que se concebía como ancilar a la normalidad de
su funcionamiento ordinario y predestinado a una corta transición. En ese
contexto se enfatiza la precisión sobre la esencia y el ámbito de actuación
de un Gobierno en funciones, a escala estatal, si bien con complemento en
referencia a su regulación autonómica. El punto final es la reivindicación
de una regulación de un Gobierno en funciones a los efectos de limitar la
discrecionalidad de su interpretación, considerando la elusión del control
por parte del ejecutivo como una clara mutación constitucional contra le-
gem.

ABSTRACT
The continuity after elections 20th December 2015 for a long period of 315
days of the Spanish Government has promoted a deep reflection about out-
going Government. In this context, emphasis is placed on the essence and

scope of an outgoing Government in functions, at the state level, but with a
complement to its autonomous regulation. The final point is the claim of a
regulation of an outgoing government in order to limit the discretion of an
interpretation on the same, considering the avoidance of control by the ex-
ecutive as a clear constitutional mutation against legem.
