El Reino Unido transpuso la Directiva del Consejo 85/374/CEE, de 25 de julio, relativa a la responsabilidad de los daños causados por productos defectuosos, mediante la Primera Parte de la Ley Consumer Protection Act 1987.
El estudio de esta Ley inglesa resulta de máximo interés porque su artículo 4(1 )(e) ha dado lugar a un contencioso entre la Comisión Europea y el Reino Unido. Este contencioso ha sido resuelto mediante la Sentencia del Tribunal de las Comunidades Europeas de 29 de mayo de 1997. A continuación se presenta una traducción de los 9 artículos («sections») de la Primera Parte de la Ley inglesa. Para llevar a cabo esta traducción se han empleado como herramientas de referencia los textos oficiales en lenguas inglesa y española de la Directiva 85/374/CEE.
(1) This Part shall have effect for the purpose of making such provisión as ¡s necessary in order to comply with the product liability Directive and shall be construed accordingly.
(2) In this Part, except in so far as the context otherwise requires- «agicultural produce» means any produce of the soil, of stock-farming or of fisheries, «dependant» and «relatiye» have the same meaning as they have in, respectively, the Fatal Accidents Act 1976 and the Damages (Scotland) Act 1976,
producer
, in relation to a product, means
(a) the person who manufactured it,
(b) ¡n the case of a substance which has not been manufactured but has been yvon or abstracted, the person who won or abstracted it,

(c) in the case of a product which has not been manufactured, won or abstracted essential characteristics of which are attributable to an industrial or other pro-cess having been carried out (for example in relation to agricultural produce) the person who carried out that process, «product» means any goods or electricity and (subject to subsection (3) below) includes a product which is comprised in another product, whether by virtue of being a component part of raw material or otherwise, and «the product liability Directive» means the Directive of the Council of the European Communities, dated 25th July 1985, (No. 85/374/EEC) on the approximation of the laws, regulations and administrativo provisions oft-he member States concerning liability for detective products.
(3) For the purposes of this Part a person who sup-plies any product in which products are comprised, whether by virtue of being component parts of raw ma-terials or otherwise, shall not e treated by reason only of his supply of that product as supplying any of th products so comprised.
(1) Esta Parte tiene por objeto llevar a cabo la transposición de la Directiva sobre responsabilidad por producto defectuoso y debe ser interpretada de manera concorde con la Directiva.
(2) En esta Parte, salvo que del contexto se derive otra interpretación por «producto agrícola» se entenderá cualquier producto de la tierra, la ganadería o la pesca; por «persona a cargo de alguien» y por «pariente» se entenderá lo mismo que se entiende, respectivamente, en la Ley de Accidentes Mortales de 1976 y en la Ley de Daños de Escocia de 1976; por «productor», en relación a un producto, se entenderá
(a) la persona que lo fabricó;
(b) en el caso de sustancias que no han sido fabrica das sino que han sido obtenidas o extraídas, la persona que las obtuvo o extrajo;
(c) en el caso de un producto que no ha sido fabricado, obtenido o extraído, sino que ha sido sometido a un proceso industrial o de otro tipo que afectó a sus características esenciales (por ejemplo, en relación a productos agrícolas), la persona que llevó a cabo este proceso; por «producto» se entenderá cualquier mercancía, incluyendo la electricidad, y también se entenderá (sin perjuicio de lo establecido en el apartado (3) de este artículo) todo producto que forme parte de otro producto, bien sea como parte integrante o como materia prima, o por cualquier otro motivo; y por «la Directiva sobre responsabilidad por productos defectuosos» se entenderá la Directiva del Consejo 85/374/CEE, de 25 de julio de 1985, relativa a la aproximación de las disposiciones legales, reglamentarias y administrativas de los Estados miembros en materia de responsabilidad por los daños causados por productos defectuosos.
(3) A los efectos de esta Parte, toda persona que suministre un producto del que formen parte otros productos, bien sea como partes integrantes o como ma, Jrias primas, o bien por cualquier otro motivo, no ser considerada como suministradora de los productos componentes por el mero hecho de haber suministrado el producto del que éstos forman parte.
(1) Subject to the following provisions of this Part, where any damage is caused wholly or partly by a defect in a product, every person to whom the subsection (2) below applies shall be liable for the damage.
(2) This subsection applies to
(a) the producer ofthe product,
(b) any person who by putting his ñame on the pro duct or using a trade mark or other distinguising mark ¡n relation to the product, has held himself out to be the producer of the product,
(c) any person who has ¡mported the product into a member State from a place outside the member States in order, in the course of any business of his, to supply to another.

(3) Subject as aforesaid, where any damage is caused wholly or partly by a defect in a product any person who supplied the product (whether to the person who suffered the damage, to the producer of any product in which the product in question is comprised or to any other person) shall be liable for the damage if
(a) the person who suffered the damage requests the supplier to identify one or more of the persons (whether still in existence or not) to whom subsection (2) above applies in relation to the product,
(b) that request is made within a reasonable period after the damage occurs and at a time when it is not reasonably practicable for the person making the request to identify all those persons, and
(c) the supplier fails, within a reasonable period after re-ceiving the request, either to comply with the request or to identify the person who supplied the product to him.
(4) Neither subsection (2) ñor subsection (3) above shall apply to a certain person in respect of any defect in any game or agriculture produce if the only supply of the game or produce by that person to another was at a time when had not undergone an industrial process.
(5) Where two or more persons are liable by virtue of this Part for the same damage, their liability shall be joint and several.
(6) This section shall be without prejudice to any liability arising otherwise than by virtue of this Part. Artículo 2° Responsabilidad por productos defectuosos
(1) Sin perjuicio de lo establecido más adelante en esta Parte, siempre que un daño sea causado en todo o en parte por un defecto, aquella persona a quien le sea aplicable el apartado (2) de este artículo será responsable del daño.
(2) Este apartado se aplica a
(a) el productor del producto;
(b) cualquier persona que se presente como productor al poner su nombre, marca o cualquier otro signo distintivo en el producto;
(c) cualquier persona que importe el producto en un Estado miembro desde un lugar situado fuera de los Estados miembros para, en el marco de su actividad comercial, suministrárselo a otra persona.
