RESU MEN:
El Real Decreto-ley 7/2018, de 27 de j ulio, sobr e el
acceso universal al Sistema Nacional de Salud ha
venido a revert ir la reforma operada por el Real
Decret o-ley 16/ 2012 , de 20 de abr il, de medidas
urgentes para garant izar la sost enibilidad del Sistema
Nacional de Salud y m ej orar la calidad y seguridad de
sus pr est aciones en m ateria de derecho a la asisten cia
sanitaria y más concretam ente en lo que tenía que v er

con la privación del d erecho a la asist encia sanit aria con
cargo a fon dos públicos de los ext ranj eros que se
encont rar an en una situ ación ir regular en España.
Esta reform a viene precedida de diversas sentencias del
Tribunal Constitucional sobre la anterior norma y trata
de recuperar un principio de un iversalidad de la
pr estación sanit aria en España.
Para llevar a cabo la modificación se regula el concepto
de titular y el reconocim iento del derecho a la
protección a la salud y a la atención sanitaria con
especial m ención a la protección de la salud y atención
sanitaria a las personas ext ranj eras que encontr ándose
en España no tengan su residencia legal en el territ or io
español y la aportación f arm acéut ica de las m ismas.
Se ref ormulan y mantienen los conceptos de asegurado
y beneficiar io pero únicam ente a efectos de lo previsto
en la norm at iv a int er nacion al y la aportación a la
pr estación farm acéutica.

Abstra ct: The Royal Decree-law 7/ 2018, of July 27, on
universal access to t he National Healt h System has
com e to reverse the reform operated by Royal Decree-
law 16/ 2 01 2, of April 20, of ur gent m easur es to
guarant ee the sustainab ility of the National Health
System and improve the qu ality and safet y of it s
ben efits in t er ms of the r ight t o healthcare and, more
specifically, in relation t o th e deprivat ion of the right to
health care charged t o public funds of foreigners that
they w ere in an irr egular situation in Spain.
This reform is preceded by various j udgm ents of t he
Constitutional Court on the pr evious r ule and seeks to
recover a principle of universality of healt h pr ovision in
Spain.
