Abstract: The most serious obstacle to implementing Article 86.3 LET lies in its interpretation. The rule, introduced by Law 3/2012, can be described as poor legislative drafting. The present article interprets the first precept within a generic core problem of every collective bargaining agreement: duration and non-withdrawal. Then, the history of the regulatory framework of Article 86.3 LET is studied; finally, a comprehensive interpretation of the rule in the entire text of the Workers’ Statute is proposed.
