a Third Country Perspective
1. INTRODUCTION
e Treaty of Lisbon1 that entered into force in 2009 has brought
about a crucial change in the eld of regulation of foreign direct inves-
tments. is sphere has become one of the EU competencies under Article
207 TFEU, which mentions «foreign direct investment» as one of the issues
covered by common commercial policy.
e new competencies of the EU in the eld of foreign direct inves-
tment provided for by Art. 207 TFEU are a highly debated topic within
the EU: indeed, there is a need to clarify, which competencies EU Member
