Abstract: Recent legislative reforms which comply with the mandates of the European Union are part of an overhaul of current nuclear labour institutions. Such reforms convey a process of constitutional reform de facto, difficult to reconcile with the provisions of Title X of our Constitution. Thus, the adequacy of article 93 CE to convey a constitutional reform resulting from the application of the principle of primacy community requires further assessment.
