RESUMEN: La armonización del Derecho de Familia en Europa es algo
que tal vez no se ha planteado frecuentemente, pero cuya necesidad existe,
como veremos en el presente trabajo. Si bien se niega por muchos la posibi-
lidad de una armonización, y siquiera una aproximación, de los Derechos de
Familia europeos, las objeciones planteadas en contra no son verdaderamente
consistentes y de hecho tanto históricamente existía una base común constituida
por el Derecho romano, canónico y común, como en la actualidad se producen
fenómenos de convergencia derivados de la existencia de unos valores comunes.
Por ello, ya estamos asistiendo a la convergencia espontánea de los distintos
Derechos de Familia de los países europeos en ciertas materias, aunque pueden
citarse precedentes. La Unión Europea, si bien adolece de una falta de compe-
tencias directas y específicas en esta materia, también se ha manifestado por la
necesidad de una armonización del Derecho de Familia, tanto en declaraciones
y resoluciones como en un importante paquete de Reglamentos, sin embargo
de alcance bastante limitado, restringido al Derecho Internacional Privado y

quedando pendiente una armonización del Derecho sustantivo —salvo algunas
tímidas excepciones—, por lo que no se resuelve la totalidad de los problemas
que se plantean en este ámbito. En ese sentido, son de destacar los intentos
académicos por lograr esa aproximación.
ABSTRACT: The harmonization of Family Law in Europe is a perhaps not
frequently raised issue, but whose need exists, as we will see in this paper.
While the possibility of a harmonization, and even an approximation, of Eu-
ropean Family Laws is denied by many authors, the objections raised against
are not truly consistent and in fact both historically there was a common base
constituted by Roman, Canon and Common Law, as at present there are con-
vergence phenomena derived from the existence of common values. Therefore,
we are already witnessing the spontaneous convergence of the different Family
Laws of European countries in certain areas, although precedents can be cited.
The European Union, although suffering from a lack of direct and specific
competences in this matter, has also pronounced in favour of the need of a
harmonization of Family Law, both in declarations and resolutions and in an
important package of Regulations, however, with a limited scope, restricted to
International Private Law, and still pending a harmonization of substantive
law —except for some timid exceptions—, so that the totality of the problems
that arise in this area is not resolved. For this reason, we can foreground the
academic attempts to achieve this approach.
