The human rights and the international trade

Abstract: This article analyzes the relationship between the human rights and the international trade, showing that in the present state of the international law there is a full breakup between both spheres, on the one hand that of the investment and the international trade and on the other hand the field of the human rights. We show critically the progressive depreciation of the human rights in connection with the rules of the global market. Especially with respect to the transnational companies, which use "soft law" tools to protect the universal human rights, and in which the growth of private international rules, like the ISO 26000, is a widespread trend.

The regulation of the structure of the collective bargaining after the recent working reform

Abstract: In the present context of economic crisis, one of the main aims of the working reforms which have been made is to promote the collective bargaining in the company, trying to stimulate a more flexible regulation of the working relations. However, and apart from the importance of the role the negotiation in the company must have, the change of the rules on trading structure by the law-maker on the one hand and the spread of the mechanisms of business abandonment of the agreement in the sector on the other hand, create outstanding twisting in the collective bargaining system, questioning the role given to the collective autonomy in the constitutional frame.
