Working reforms and employment policies

Abstract: The reforms which are taking place in Spain in employment policies are determined by the itineraries drawn by the Community institutions to move forward in a model of flexicurity subjected to strict criteria of economic policy. We analyze the new rule orientations in the Law of Employment and its development, with lights and shadows, in the field of active policies of employment, the professional training and the intermediation tools. A general critique to the legal frame and to the employment policies in Spain lies in the lack of institutional coordination, the slow advances in training policies, the reiteration of poor incentive policies of contracting, and a flexibility of the negotiation of the employment policies which does not come with the updating of the public services, as it is shown by the low investment in material and human resources and by the difficulty to put forward in a complete view of the employment services.

The effect of the labour reform of 2012 in the professional ranking and the functional mobility

Abstract: In this study we try to deal with the effect of the legislative reform made through the Law 3 / 2012 of 6th July has had on the professional ranking and functional mobility institutions. With regard to the professional ranking, we analyze five points, specifically: the withdrawal of the professional standing and the salary levels as professional ranking criteria; the equality of the working benefits in the working contract to a professional group; the possibility the functional versatility is played among professional groups; the incorporation of new qualification criteria like the professional tasks, functions and specialties; and to finish with the priority given to the business agreement as a privileged frame in the negotiations of the professional ranking.
