In this paper, a stance is introduced which ex-
plains that the objective element of the recklessness
offense does not differ at all from the objective element
of intentional crime and hence their differentiation is
on the side of the subjective element. e first relevant
consequence would be that the objective imputation
and its dogmatic sub-institutes govern in the same way
both modes. To build our position we started off the
pair policy-intellective knowledge/no criminally rele-
vant legal knowledge. In addition, we have proposed a
standardization of the types of guilt that understands
not as conscious/unconscious but as expected/not ex-
pected. Finally, the question of the gravity of the im-
prudence is addressed and it is noted that although this
does not add to the problem of determination of reck-
