AN ELUSIVE CONTROL

RESUMEN
El artículo analiza la fase de preparación del nuevo recurso de casación y
las atribuciones que se confieren a los Jueces y Tribunales que han dictado
la sentencia recurrida en la nueva Ley 7/2015. En especial, aborda cuestio-
nes prácticas, como el régimen transitorio, la intensidad del control por el
órgano recurrido del escrito de preparación al recurso y la opinión fundada
que le es posible emitir si considera que puede concurrir interés objetivo
casacional. El artículo contiene una referencia a diversos pronunciamientos
del Tribunal Europeo de Derechos Humanos que han señalado la rigidez en
la admisión del recurso de casación por el Tribunal Supremo.

ABSTRACT
The article analyses the phase of preparing the new appeal in cassation and
the competences of judges and courts that have handed down the judgment,
under the new Law 7/2015. In particular, it addresses practical issues, such
as the transitional arrangements, the intensity of control by the appealed
